Our Services and Service Materials

Host Happy offers certain services for purchase, including but not limited to vacation rental consulting, interior design, vacation rental property management, and packages consisting of combinations thereof (collectively, the “Services”).

Host Happy provides certain materials as part of its Services, including but not limited to monthly status reports, estimated revenue for your property or potential vacation rental properties, opinions on potential vacation rental properties, and emails containing written advice (collectively, the “Service Materials”).

We Have Limited Liability

Host Happy does not guarantee any amount of revenue whatsoever, or that all applications for business licenses will be successful. Further, Host Happy does not guarantee the legality of your vacation rental, or make any representations with respect to the tax implications of renting property on a short-term basis. Host Happy is not liable for any unsuccessful business license applications, tax obligations, damage claims, or any other claims of any kind relating to or arising from the Services or your property. Host Happy is not affiliated with any mortgage professional, realtor, lawyer or other person or organization it refers you to.

You are solely responsible for the content of any insurance application, business license application, GST registration form, or tax return in respect of your property. You are solely responsible for ensuring any application(s), form(s), return(s) or other documentation relating to your property adheres to the application, form, return or document requirements, timelines, and rules. You are solely responsible for ensuring any obligations in respect of the property are met.

Host Happy is not liable for any loss, injury, claim, liability or damage relating to the use of the Site, any Services, Service Materials, advice, or any other information contained on the Site. You agree to use our Site, Services, Service Materials, advice, and any other information contained on the Site at your own risk.

Our Services May Be Delivered Remotely

Host Happy may deliver all purchased Services and Service Materials remotely via internet or phone. Host Happy may deliver Services and Service Materials by email, phone, Zoom, or an alternative video messaging service where appropriate. Host Happy is not responsible for delivering any services in-person or by mail. You are solely responsible for ensuring your own access to email, phone, Zoom, or an alternative video messaging service. You are responsible for any fees associated with your internet and phone service. 

Your Documents

Any documents or data you choose to send to Host Happy by email are not reviewed or pre-screened by Host Happy. You are responsible for uploading or emailing Host Happy the correct documents or data necessary for Host Happy to deliver your purchased Services. You grant Host Happy a non-exclusive, royalty-free license to use your uploaded or emailed documents or data for the purpose of delivering Host Happy’s services.

Use Our Site for Personal Use Only

You agree to use the Site for personal, non-commercial purposes only. You agree not to reproduce, share, modify, sell, or distribute Site content for any purpose whatsoever. You agree to use the Site for lawful purposes only. You agree not to use the Site for market-research purposes or to solicit any of Host Happy’s employees, contractors, or advisors for outside work or employment of any kind.

You agree to use the Services and Service Materials for personal, non-commercial purposes only. You agree not to reproduce, share, modify, sell or distribute the Services and Service Materials for any purpose whatsoever except for use in your personal school or employment applications, and at your own risk.

Do Not Infringe Our Intellectual Property Rights

All content, terms, names, logos, and trademarks on the Site or distributed to you by Host Happy, including but not limited to as part of the Services and Service Materials, are the intellectual property of Host Happy. Host Happy reserves all such intellectual property rights. You agree not to copy, reproduce, distribute, republish, share, or modify any content, terms, names, logos, or trademarks of Host Happy by any means whatsoever, except with the express written permission of Host Happy. Nothing on the Site or in the Terms grants you an implied license or right to any content, terms, names, logos, or trademarks of Host Happy whatsoever.

We Can Terminate Your Access

Host Happy may terminate or restrict your access to the Site, including but not limited to deleting any information contained therein, at its sole discretion and without notice. Any breach of the Terms automatically terminates your use of the Site.  

You Agree to be Contacted by Phone or Email

By providing Host Happy with your phone number, you agree to receive phone calls and text messages from Host Happy. By Providing Host Happy with your email you agree to receive emails from Host Happy, including but not limited to promotional emails advertising Host Happy Services and events.

We Can Change These Terms

Host Happy may, at its sole discretion and without notice, add, remove, revise, or otherwise make changes to the Site, Services, and Service Materials. This includes but is not limited to adding, removing, and making changes to the price and features of Services and Service Materials.

We Are Not Responsible for Third Party Links

Host Happy is not responsible for any third-party sites linked to on the Site. Host Happy does not make any warranties or representations regarding the products or services available on other sites. Host Happy is not responsible for the accuracy or reliability of the information contained on third-party sites. You are solely responsible for reading the policies of any third-party websites.

You Agree to Our Privacy Policy

You agree to the Host Happy Privacy Policy, which can be viewed at https://hosthappy.ca/privacy-policy.

We Are Not Liable for Any Use of, or Inability to Access the Site

Host Happy does not guarantee that the Site, including but not limited to the Services, will be accessible. Host Happy is not liable for any losses or damages whatsoever arising in any way from your use of, or inability to access the Site, or Services. 

We Do Not Make Any Warranties or Representations

Host Happy does not make any warranties or representations of any kind, express or implied, including but not limited to warranties as to merchantability or fitness for a particular purpose.

You Agree to Indemnify Us

You agree to indemnify and hold harmless Host Happy including any and all officers, directors, shareholders, employees, or contractors from all claims and or expenses which may arise from your use of the Site.

You Agree to Dispute Resolution

In the event of a dispute arising from the Terms, you and Host Happy agree to participate in binding, confidential arbitration before an arbitrator in Vancouver, British Columbia, Canada. The decision of the arbitrator will be final and confidential. This clause does not apply to the enforcement of intellectual property rights or privacy matters.

You agree to waive your right to participate in a class action proceeding of any kind against Host Happy.

The Law of BC, Canada Applies

The Terms are governed by the laws of Canada and the laws of the province of British Columbia.
